GENERAL CONDITIONS OF SALE
Confirmation of orders is subject to acceptance by BUREAU INDIGO of the individual customer account.
2. INFORMATION AND AVAILABILITY OF PRODUCTS
2.1 All offers of products, services and delivery methods, at the prices indicated in euros, are valid in mainland France subject to available stocks. For orders originating in the European Union, the rate of VAT applicable is the same as that in France. Shipping costs will be indicated at the time of selection of the delivery method. For all queries relating to postage charges, please refer to clause 12. For all queries concerning delivery to countries outside zone A (European Union, Switzerland and Norway), please contact us. The articles which we sell are described and presented as accurately as possible. If errors become apparent despite our precautions, particularly regarding size recommendations, we can in no circumstances be held liable. The photographs of the products are of illustrative value only as alterations may occur as a result of uploading to the website. Unless provided otherwise by warranty, any transaction between cubjeans.com and its customers which is not contested within 14 clear days after delivery cannot give rise to a claim.
2.2 The company BUREAU INDIGO / CUBJEANS presents products for sale on its website pro.cubjeans.com having the characteristics required to comply with article L 111-1 of the Consumer Code, which provides for the ability of potential consumers to know the essential characteristics of the products they wish to buy before placing a definitive order.
2.3 The products offered by BUREAU INDIGO / CUBJEANS are only valid while stocks are available. In the event of the product ordered being unavailable from our suppliers, the customer will be informed as soon as possible and will have the option of cancelling the order. The customer will have the choice of either requesting a refund of the sums paid within 30 days of their payment, or exchanging the product.
2.4 BUREAU INDIGO / CUBJEANS reserves the right at any time to modify or withdraw from sale any of the products offered on the website. Such modifications will have no effect on orders placed on cubjeans.com before the modifications came into force.
2.5 Sale items cannot be exchanged or refunded.
3. ACCEPTANCE OF ORDERS
A customer wishing to purchase a product or service must:
– complete the identification form by specifying the personal details requested or identify himself if he is an existing customer;
- fill in the online order specifying all the details of the products or services chosen;
– check his order;
– make payment in the required manner;
– confirm his order and payment.
Confirmation of the order implies acceptance of these conditions of sale, acknowledgement of the customer's complete knowledge of them, and repudiation of his own conditions of purchase or other conditions.
The information supplied and the confirmation recorded constitute proof of the transaction. Confirmation is the equivalent of a signature and constitutes acceptance of the transaction. BUREAU INDIGO / CUBJEANS will send via email confirmation of the order placed.
4. ORDER
An order can only be placed on the website if you are clearly identified by having created an account on cubjeans.com. All orders constitute acceptance of the prices and descriptions of the products available for sale. The contract is agreed on sending confirmation of your order. After acceptance of your order, it will be forwarded to our logistics department for processing. You will receive an initial automated email within one hour acknowledging receipt. You can obtain information about your order at any time under My Account - My Orders on the cubjeans.com website, by emailing contact@cubjeans.com

5. PRICES
Prices are shown in euros and include VAT at the current French rate.
The seller reserves the right to alter its prices at any time; however, it is understood that the price shown in the catalogue on the day the order is placed shall be the one applicable to the purchaser.
The prices shown include the cost of processing the order but not shipping and delivery costs (see delivery terms under clause 12).
6. PAYMENT METHODS
6.1 BY BANK CARD
The payment will be made via the secure banking system of our partner (PayPal). This means that none of your bank details will be stored on the cubjeans.com website. Payment using a bank card is therefore totally secure. Your order will be saved and confirmed after acceptance of payment by the bank. Your credit card details are encrypted by SSL (Secure Socket Layer) and are never visible over the network. Payment is made immediately by the bank. BUREAU INDIGO / CUBJEANS never has access to your bank details and does not store them on its servers. This is why you are asked for them with every new transaction on our website.
6.2 RETENTION OF TITLE
The products remain the property of BUREAU INDIGO / CUBJEANS until payment has been received in full by BUREAU INDIGO / CUBJEANS (law 83 335 dated 12/05/1980).
6.3 DEFAULT IN PAYMENT
BUREAU INDIGO / CUBJEANS reserves the right to refuse to make a delivery or honour an order from a customer who has not paid a previous order in full or in part, or with whom a dispute regarding payment is in progress.
6.4 ANTI-FRAUD CHECKS
BUREAU INDIGO / CUBJEANS carries out checks against all orders placed on its pro.cubjeans.com website. These checks are designed to protect BUREAU INDIGO / CUBJEANS from fraudulent activity. As part of these procedures, we may ask you for any information necessary to expedite your order: proof of address, debts in your name etc. Such requests will be made by email, then by mail with return receipt.
7. DELIVERY METHODS AND TIMESCALES
BUREAU INDIGO / CUBJEANS undertakes to process customer orders at the latest on the day after the order is placed, from Monday to Friday. Your parcel will then be dispatched within 48 hours (2 working days) by Colissimo in zone A. Delivery times are specified in clause 11. Delivery times are provided for illustration purposes only. No compensation can be claimed if an order cannot be delivered, whether as a result of an unforeseen halt in production or as a result of strikes, accidents, natural catastrophes, inability to obtain stocks or any for any other reason out of our control. 8. SATISFACTION OR YOUR MONEY BACK
In order to guarantee your complete satisfaction, BUREAU INDIGO / CUBJEANS undertakes to exchange any article which is the wrong size or fit or which is otherwise unsatisfactory. You have 14 days after receipt of your order to request exchange or refund of any unworn items, in their original packaging, which you do not require (see clause 12).
Items which have deteriorated or whose labels and brand markings are no longer present cannot be returned.
8.1 For customers in mainland France, exchange of products is free and you will not have to pay any further shipping costs. 8.2 For other customers, once you have chosen a replacement product (see above), return of the product to Concept Store CUB, 10 rue du Château d'eau, 75010 Paris, France is at your expense. On receipt of the product to be exchanged, the replacement product will be shipped free of charge by Bureau Indigo.
9. LEGISLATIVE PROVISIONS OF THE "INFORMATIQUE ET LIBERTES" LAW (DATA PROTECTION ACT - FRENCH LAW N° 78-17 OF JANUARY 6, 1978)
The cubjeans.com website has been declared to the CNIL (National Data Protection and Privacy Commission) under reference number 1619832. In conformance with the Data Protection Act of 6 January 1978 (referred to as "Informatique et libertés"), you have the right to access, rectify and contest the personal information concerning you which is collected during our transactions and which is necessary for processing your order and managing our business relationship.
10. RESPONSIBILITIES AND MANAGEMENT OF DISPUTES
10.1 BUREAU INDIGO / CUBJEANS cannot accept responsibility for inconvenience or damage resulting from use of the internet such as interruption of service, the presence of viruses or intrusions by outside parties, or in general any occurrence considered by the courts to be force majeure.
In the event of a dispute, an amicable solution will be sought before any legal action is taken. In the event of legal action, the competent tribunal shall be the Paris Chamber of Commerce.
These conditions are subject to French law.
10.2 The customer is responsible for maintaining the confidentiality of his account and password and shall be wholly responsible for all activities and transactions carried out using his account or password. The customer undertakes to inform BUREAU INDIGO / CUBJEANS immediately of any unauthorised use of his account or password. The customer must ensure that all information provided is complete and exact and undertakes to inform BUREAU INDIGO / CUBJEANS of any changes to his information. The customer may access and update his information via the 'My Account' area of the pro.cubjeans.com website. The website reserves the right to suspend or remove a customer account at any time.
11. COPYRIGHTS
The www.cubjeans.com website and its textual and graphical content are the property of BUREAU INDIGO / CUBJEANS. Any reproduction in whole or in part of the components of the cubjeans.com or pro.cubjeans.com website requires prior written agreement from S.A.S BUREAU INDIGO.

All goods are shipped at the risk of the purchaser. It is the purchaser's responsibility to check the goods on arrival, to pursue his remedies against the shipper within the required timescales, and to inform the seller within 48 hours of delivery of any complaint relating to quantities or to the condition of the goods supplied. The goods remain the property of the seller until paid for in full. The goods are at the risk of the purchaser.
13. PROCEDURE FOR RETURN OF GOODS
In conformance with the law, you have a period of 14 days from the date of receipt of your order to return a product which is not a sale item if you are not completely satisfied with it. Procedure for the return of goods
For customers in mainland France: Send an email to contact@cubjeans.com. On receipt of your email we will send you a Colissimo return slip for you to attach to the parcel. Leave the parcel at your post office. On receipt of the returned goods and acceptance by our returns department, the refund or exchange process will be initiated.
For customers outside mainland France: Return of the product to be exchanged or refunded is at your expense. On receipt of the returned goods and acceptance by our returns department, the refund or exchange process will be initiated.
Attention! For your return to be accepted, it is essential that all the labels are present on the product. We will not accept used products or ones for which the product markings (labels etc.) are missing. Under no circumstances can BUREAU INDIGO / CUBJEANS be held responsible for loss or damage to parcels being returned or exchanged.
14. DISPUTES
Applicable law and competent jurisdictions
These conditions are subject to French law. In the event of a dispute the competent tribunal shall be that of the place of domicile of the defendant in conformance with article 42 of the new code of civil procedure or, at the choice of the plaintiff, that of the effective place of delivery of the product in conformance with article 46 of the said code.
